This modular webinar series will cover the following:

Module 1 - New Build Conveyancing

This module will cover the following:

  • Pitfalls of buyer-funded developments
  • Do I need to protect a buyer’s equitable lien?
  • Issues arising on the construction of high-rise blocks of flats in England
  • Implications of industry codes of practice
  • How material information guidance is likely to apply to developers

Module 2 - Leasehold Reforms

This module will cover the following:

  • Pending changes to the statutory rules for acquiring a lease extension
  • Is an extended lease a qualifying lease under the BSA?
  • Potential implications if the landlord fails to provide a timely and valid landlord certificate (relevant building)
  • Reforms to residential service charge accounts
  • Requesting sales information

Module 3 - Planning & Building Regulations

This module will cover the following:

  • Homeworking: is planning permission required?
  • Permitted development rights - is the local authority’s approval needed?
  • Article 4 directions and when they might be made
  • Extended limitation periods (planning and building regulations)
  • Key recent changes to the building control regime

Module 4 - SDLT Updates

This module will cover the following:

  • Dwelling surrounded by several acres of land: is the purchase wholly residential?
  • Empty property in need of extensive repair and renovation: is it suitable for use as a dwelling?
  • Does the day or time of completion determine the character of the property for tax purposes?
  • The latest on disputed high-value transactions where company purchaser paid less than 15%

Module 5 - Recent HM Land Registry Changes

HM Land Registry is central to the work of all conveyancing lawyers. Keeping up to date with HMLR changes is not just the job of the post-completion team. If you do not complete your registration in a timely manner, there will be serious consequences for the fee earner with conduct of the file and the firm.

This update will cover:

  • HMLR fees
  • First registrations
  • Prescriptive easements
  • Local land charges
  • Basic land law and recent Practice Guides

Module 6 - Auction Cases - Risks for Conveyancers

Conveyancing lawyers have prepared auction packs for seller clients for years without too much concern. However, a recent case has cast doubt on what many conveyancers would consider to be acceptable practice. Combine this with Material Information requirements and the demand for upfront information and conveyancers have a toxic mix.
