Passing off is sometimes brought alongside a trade mark claim, design rights claim and/or copyright claim, demonstrating its breadth and versatility. A passing off claim can also be brought by itself, where no other rights will be effective.
This virtual classroom seminar will cover the law of passing off in the UK. It will focus on the different forms of misrepresentation that can occur and explain the sort of evidentiary support that would be needed to successfully bring a passing off case.
The session will provide those new to this area with an invaluable introduction to the broad scope of passing off, and will serve as a refresher to the different types of passing off that can be relied on for delegates with prior knowledge.

Passing off is sometimes brought alongside a trade mark claim, design rights claim and/or copyright claim.
This demonstrates its breadth and versatility.
For this reason, it is always worth at least considering a passing off claim whenever there is potential infringement of IP rights.
However, a passing off claim can also be brought by itself, where no other rights will be effective.
For example, there are instances where a trade mark claim would not be feasible but a passing off would be - this would include when a sign is unregistered or when the claimant needs to rely on the overall get-up of a product rather than a specific sign.
