The world of competition litigation and class actions is evolving quickly, and this year has seen a number of firsts, including the first court approved settlements in collective proceedings and first Court of Appeal judgment in a secret cartel case, in which the Court has given guidance on important matters such as expert independence and the role of expert evidence.
There have also been developments in litigation funding following the judgment in PACCAR last year and in the law of pass-on as the CAT grapples with handling cases at different levels of supply chains.
