In this webinar, Ian Gascoigne has chosen ten such cases where judgments were given in 2024. These are, of course, not only the important cases but a guide to the diverse issues that can occur in commercial disputes and, inevitably, will crop up in other settings too.

Cases to be discussed include Tesco v USDAW; Al Sadeq; Obaid; RTI v MUR Shipping; and Tintometer v Pitmans.

Introduction

Every year hundreds of cases reach the courts requiring a decision, the report of which will be of wider significance to lawyers handling commercial litigation. Keeping on top of these can be a challenging task for busy practitioners.

In this webinar, Ian Gascoigne has chosen ten such cases where judgments were given in 2024. These are, of course, not only the important cases but a guide to the diverse issues that can occur in commercial disputes and, inevitably, will crop up in other settings too. The decisions range from two appeals decided by the Supreme Court and others in the Court of Appeal to cases determined at first instance.

What You Will Learn

This webinar will cover the following:

  • The Supreme Court implies a term into employment contracts [Tesco v USDAW]
  • The latest on legal professional privilege from the Court of Appeal [Al Sadeq]
  • Effective drafting of settlement agreements [Obaid]
  • Does a ‘reasonable endeavours’ provision require another party to accept an offer of performance outside of the contract before it may invoke a ‘force majeure clause’ in the contract’? [RTI v MUR Shipping]
  • The battle of the logos - Lidl litigates with Tesco over yellow circles on blue backgrounds
  • Can later-added parties apply to set aside case management orders made before they were made parties? [Tintometer v Pitmans]
  • Claims in equity and defences to them
