It is a difficult time for everybody with many families and businesses facing the realisation that they will not be able to maintain their mortgage payments and therefore face repossession claims as a result.

This live and interactive session is recommended for legal professionals in the banking litigation and debt recovery fields who wish to improve their knowledge of the repossession process. The course is designed to cover the process from start to finish, focussing on the current financial climate and how practitioners can make the most of the process to ensure the best outcome for their clients.

This course is most suitable for practitioners who already have at least a basic understanding and knowledge of both the repossession order process and whilst the course will include some reference to the basics, it will concentrate on more intricate matters found within the banking litigation procedure.

What You Will Learn

This live and interactive course will cover the following:

  • Preliminaries of the repossession process, including obtaining a charging order, enforcing that order (be that a possession order or an order for sale), and seeking recovery
  • Completion of the Part 8 Claim Form, witness statements and associated evidence necessary when submitting the order for sale application
  • A detailed look at the discretion of the court, and the orders that can be made following the order for sale hearing
  • Suspension of an order, appealing an order and failure of an order
  • Distribution of assets and monies following a sale
  • Recent case law updates
