This live session aims to hit the main issues in this area, with practice points in parallel and tips for evidence gathering. Introduction

This virtual classroom seminar considers the topics of transparency and disclosure in private children law cases.

Transparency is a buzzword and there have been pilots and protocols but the jurisprudence is complicated and often misunderstood. This live session intends to try to simplify it into what you need for most cases.

Disclosure is always important. Any specialist practitioner will know how often statutory services disclosure is responsible for delays in cases and how the evidence available, especially from neutral third parties, rather than partisan parents, can have such a central effect upon the outcome of a case.

  • Transparency
    • A more simple guide to the statutory guidance, procedure rules and caselaw - useful for most cases running through the Family Court and allowing digestible and comprehensible advice to clients.
  • Disclosure - consideration of the law behind disclosure and cases about particular issues:-
    • What you can disclose from these proceedings into other proceedings or to third parties
    • What other material you can disclose into these proceedings, and how maybe from criminal or financial proceedings
    • Disclosure of unusual evidence such as google camera footage; the new Police disclosure protocol
    • Practice points within this structure, what might be useful and why and how to manage the process at each stage
    • Evidence gathering tips - what you might look for in different type of private law proceedings from relocation to fact finding hearings
