Much in the spotlight recently, disclosure can be a tricky issue for both the prosecution and defence. If prosecuting it can be the issue which brings down a case; if defending it can be the key to unlocking a case.
This webinar presented by barrister Clive Smith will cover disclosure in the magistrates' court - Part 8 of the Criminal Procedure Rules, defence statements and s8 of the CPIA in the magistrates' court and the Criminal Procedure & Investigations Act 1996 in the Crown Court. Disclosure by the defence and whether you can still put the Crown to strict proof will be examined, as will useful case-law in relation to late defence statements and interpretation of the CPIA.
