Course description

In any employment claim, it is essential to have a clear understanding of the potential awards that could be made by the Tribunal whether you act for the Claimant or Respondent.

What do Tribunals look for in the content and layout of a Schedule of Loss? What is the current approach to assessing pension loss? How do you manage a Claimant’s expectations of what they are likely to record by way of compensation if they are successful?

Presented by the hugely popular speaker Alastair Hodge, a barrister who specialises in all aspects of employment law, this live and interactive session will examine the general principles for assessing basic and compensatory awards, heads of loss, mitigation, Polkey, contributory fault, the impact of the ACAS Code of Practice, tax and interest, as well as looking at the assessment of compensation for discrimination claims under the Equality Act 2010.

Introduction

It remains the position that most cases in the Employment Tribunal will inevitably settle. Those that are not compromised may well end up with findings against an employer that will lead to an award of compensation in favour of the claimant employee.

But how confident are you to subsequently deal with issues of remedy, whether in the context of an unfair dismissal claim or a discrimination claim?

This new virtual classroom seminar will provide solicitors and HR professionals with practical guidance on the best ways to go about dealing with remedy issues in the Employment Tribunal, whether in an effort to settle a case or at a remedy hearing.

What You Will Learn

This live and interactive session will cover the following:

  • Calculation of basic award in an unfair dismissal claim
  • Calculation of compensatory award in an unfair dismissal claim
  • Approaching injury to feelings awards
  • Aggravated & exemplary damages
  • Compensation awards in detriment cases
  • Producing schedules & counter schedules of loss
  • Preparing remedy witness statements
