Introduction

This webinar will focus on the more complicated aspects of the billing of Magistrate’s Court work.

The webinar assumes a high level of knowledge on your part and will appeal to those who are experienced in the billing of such matters but who occasionally must deal with difficult files.

What You Will Learn

This webinar will cover the following:

  • Enhancements - how to make out a case for the hourly rate plus a 100% enhancement
  • Dealing with the billing of those clients who have several files
    • How many cases do you have?
    • How many claims can you make?
  • You have 4 clients in the same case 2 of whom elect Crown Court jury trial - 2 of whom plead guilty and are committed for sentence - how many fees have you got?
  • You have 2 clients in the same case - one of whom elects Crown Court jury trial and the other pleads guilty and is adjourned for PSR’s and sentencing in the Magistrates’ Court - how many fees have you got?
  • You have 2 clients in the same case - one of whom elects Crown Court jury trial and the other pleads guilty and is sentenced on the same day as the sending - how many fees have you got?
  • Certain breach proceedings cannot be classified as an offence whereby you can receive a separate fee for them - which breach proceedings fall into this category, and which do not?
  • What category of case are you dealing with where the client pleads not guilty to common assault and guilty to driving with excess alcohol? - the Crown having offered no evidence on the not guilty offence and the matter having been dismissed
  • What fee(s) can you claim where the client elects’ trial by jury on one offence and pleads guilty to another offence and is committed for sentence on the offence to which the guilty plea was entered?
  • The youth entered a guilty plea and was committed to the Crown Court for sentence - the Judge sends the matter back to the Youth Court - how many fees, and what types, are claimable in these circumstances?
  • The youth is sent to the Crown Court for trial - the Judge sends the matter back to the Youth Court for trial - how many fees, and what types, are claimable in these circumstances?
  • The client has 6 different cases in the Magistrates’ Court and all 6 cases are dealt with at the one sentencing hearing - how, if at all, does this affect the fee claimable?
  • What is the definition of a ‘case’ within your 2022 Standard Crime Contract Specification document?
  • Certificates for Counsel in the Youth Court - how it all works
