Asylum and Refugee Law (French)
What is asylum?
What is the principle of non-refoulement?
Who should be recognized and protected as a refugee?
These questions relating to the right of asylum and refugees are both ancient and contemporary.
Whether you are a decision-maker, magistrate, lawyer, human rights defender, you will have to answer these questions. The answers are complex. They require specific theoretical and practical knowledge, both in national and regional law and in international law.
The in-depth analysis of the 1951 Geneva Convention relating to refugees will enable you to master these questions. This convention remains the cornerstone of international refugee protection. It is at the heart of this online course. You will analyze in detail the principle of non-refoulement as well as the definition of a refugee.
This definition allows - like the fingerprint you see in the image above - to identify the people who, legally, must be recognized as beneficiaries of refugee status and international protection. Using a conceptual tool, the theory of the three scales, you will analyze in a rigorous and structured way both each distinct element of the refugee definition (persecution, risk, proof) and, in a holistic approach, the whole definition.
By comparing the theoretical analysis with practical situations, you will find that, correctly interpreted, the Geneva Convention remains effective and imposes, even today, the protection as refugees (refugees) of many fugitives ( Fl uchtlingen )

Prerequisites
Have completed an undergraduate graduate program in law (bachelor, license, LL.B., etc.).
Or have followed an undergraduate program of higher education in a field other than law and have practical experience in human rights (being in regular contact with migrants, working within asylum authorities or collaborating with an association helping refugees, etc.).
Have a basic level (A2 of the European framework) in English.

At the end of this course, you will be able to
- formulate rigorous legal reasoning on the right to asylum and international protection,
- define and apply the notions of asylum and refugee,
- analyze case law decisions of international, regional and national jurisdictions relating to the right of asylum and refugees,
- criticize or justify the reasoning of an asylum authority (administrative or judicial) to develop arguments within the framework of a decision or an appeal,
- questioning and imagining future challenges in terms of asylum.
